Some proposals do run into insurmountable problems and the respective Council feels compelled to refuse the development application. In the event a development application is refused lodging an Appeal with the Environment, Resources and Development Court is an option. I have dealt with many appeals and attended many compulsory conferences, where the appeals process commences. In my experience it is still possible in many cases to resolve issues at the compulsory conference stage. However if compromise is still not possible then we can provide a full range of services and advice if the matter is to go to trial. Alternatively if you are involved in a matter before the ERD Court you may require planning advice or an expert witness.
